As property owners review their proposed operations assessment in the searchable Four Lakes Special Assessment District map we've received several common questions:
A community survey of all property owners in the Four Lakes Special Assessment District was sent in late January/early February to understand residents’ views of the assessment and property owner demographics. Here are some common questions we're hearing now.
The lake levels of each of the four lakes are legally established, along with the Four Lakes Special Assessment District. This was done under Part 307, Inland Lakes, of Michigan Natural Resource and Environmental Protection Act. P.A. 451 of 1994 as amended.
Click here for a legal opinion about Part 307 and the Four Lakes Special Assessment District. We encourage you to read this if you have concerns about the legality of the court order on the lake levels and Special Assessment District. Secord Township supervisor and former FLTF board member Joel Vernier sheds light on these frequently asked questions.
In accordance with Part 307, the Counties of Midland and Gladwin decided that all costs associated with the maintenance of the lake levels are to be defrayed by special assessments. The process for making, levying and collecting special assessments will be similar to the process set forth in the Michigan Drain Code of 1956, Act 40, as amended. Each property owner will receive notice of their assessment, an opportunity to participate in a public “Day of Review” and object, and have a right to appeal the final assessment following the approval of the assessment rolls by each of the county board of commissioners.
Four Lakes Task Force (FLTF) received good news that our pre-application loan for the Four Lakes Special Assessment District (SAD) was accepted and meets the eligibility requirements for a low-interest loan from the U.S. Department of Agriculture (USDA).
